Terms of Service

Effective May 28, 2026. Privacy Policy. Data Processing Agreement.

1. Who we are

Brogilvy is operated by Valued BV / Markomatic, a Belgian limited liability company. Contact: kasper@valued.be. By creating an account or accessing the service, you agree to these terms. If you don't agree, don't use Brogilvy.

2. What Brogilvy does

Brogilvy is an AI marketing assistant that helps you produce branded content (blog posts, landing pages, social copy, etc.). It is built on Anthropic's Claude Managed Agents. The service may also call third-party APIs you authorize (e.g. Perplexity for research, Copyleaks for plagiarism scanning).

3. Your account

You need a Clerk-managed account to use Brogilvy. You're responsible for the security of your credentials and for everything that happens under your workspace. Tell us immediately if you suspect unauthorized access.

4. Acceptable use

You may not:

  • Use Brogilvy to generate spam, harassment, defamation, child sexual abuse material, malware, deceptive impersonation, or content that violates third-party rights.
  • Scrape Brogilvy itself or reverse-engineer the agent for the purpose of building a competing product.
  • Resell, sublicense, or expose the API to third parties without a written reseller agreement.
  • Use Brogilvy to make automated decisions about identifiable people with legal or similarly significant effect (GDPR Art. 22).
  • Submit content that infringes intellectual property rights you don't hold.

We may suspend or terminate accounts that breach these rules. For egregious cases (CSAM, criminal use, attempts to exfiltrate other tenants' data) we will notify the relevant authorities.

5. Content ownership

You own everything you create with Brogilvy.Including your prompts, your brand context, your inventory items, your artifacts, and the output the agent generates from them. We claim no license over your content beyond what's necessary to run the service (storing it, displaying it back to you, sending it to Anthropic / Perplexity / Copyleaks to fulfill your requests).

Anthropic and other sub-processors operate on their own terms. To the best of our knowledge, Anthropic does not train on Managed Agents prompts or outputs. See their privacy policy.

You are responsible for what you publish. AI-generated content may be inaccurate or unintentionally similar to existing work. The publish gates (plagiarism + fact-check) help — they are not a guarantee. Review before you ship.

6. Subscriptions, credits & billing

Brogilvy is sold on a credit-based subscription (Starter / Pro / Agency tiers, or per-credit top-ups). Credits are consumed as the agent performs work. Subscriptions auto-renew monthly unless cancelled.

You can cancel at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for partial months. Unused credits expire 12 months after purchase if no activity.

Prices are in USD and exclude VAT. EU customers will be charged Belgian VAT (21%) where applicable. We may change pricing for future billing periods with at least 30 days' notice.

7. Service availability

Brogilvy relies on Anthropic (US), Supabase (EU), and Clerk (US). When any of these are unavailable, Brogilvy is unavailable. We monitor uptime at brogilvy.com/status.

We do not offer a contractual SLA on the free or Starter tiers. Pro and Agency customers may request an SLA addendum (typically 99.5% monthly, excluding upstream outages outside our control).

8. Termination & data export

You can delete your workspace at any time from Settings. On deletion we remove your data from production within 30 days; backups age out within 90. You can export your artifacts and inventory via the Docs panel before deleting.

We may terminate accounts that breach these terms or that are inactive for 24+ months on a free tier (with 30 days' advance notice).

9. Warranty & liability

Brogilvy is provided “as is” without warranties beyond those required by Belgian / EU consumer law. Our maximum aggregate liability in any 12-month period is limited to the fees you paid in that period.

We are not liable for the AI's creative output. We are liable for service interruptions, data loss, and security breaches to the extent legally required.

10. Changes to these terms

If we materially change these terms we will notify you by email at least 30 days before the change takes effect. Continued use after the effective date constitutes acceptance.

11. Governing law

Belgian law applies. Disputes go to the courts of Ghent, Belgium, unless EU consumer law requires otherwise.
